Information on the Processing of Personal Data

Familiarizing the data subject with information necessary to process personal data according to §19, Section 1 and 2 of Act no. 18/2018 Coll. on personal data protection and amendment and supplementation of certain acts and according to Article 13 of the Regulation (EU) 2016/679 of the European Parliament and of the Council, the data subjects (customers of the controller) are familiarized with the following information necessary to process personal data:

Company Priruz s.r.o. as the controller hereby informs you that your data is being processed within the frame of the controller’s fulfillment of obligations as the controller of the online store www.fraela.sk (hereinafter referred to as the “Controller”). During the personal data processing by the controller, you are a data subject, i.e., the person whom the processed personal data concern).

  1. What is personal data processing?

    The term “personal data processing” refers to a processing operation or a set of processing operations related to personal data or sets of personal data, especially obtaining, recording, sorting, structuring, storing, updating, searching, browsing, and usage of personal data, providing personal data via transfer, circulation, or other means, regrouping or combining, restricting, erasure of personal data regardless of whether it is performed via automatized or non-automatized means.

    Simply put, it is the collection of personal data, storage of personal data on information carriers, access, modification or changes, search, use, transmission, dissemination, publication, storage, exchange, sorting or combination, blocking, and disposal. There are a lot of them but only based on the data you provide can we provide you with services and products that will specifically improve your life.

  2. What personal data do we process?

    The personal data we process is limited to personal data you provide to us regarding your interest in our products and their purchase (e.g.: information provided at registration, orders, or your consent to personal data processing and your consent to receiving newsletters), i.e., conclusion of the contract for the purchase of goods.

    This most frequently concerns data you provide to us at registration and/or when purchasing our products:

    a) Basic identification data and address details:

    This information is the basis for the conclusion and fulfillment of a contract. This mainly refers to:
    – your first and last name,
    – email address,
    – telephone number, 
    – address where you can be contacted, i.e., the address where the purchased goods are to be delivered,
    – payment details (credit card number that will not be stored/paired with your account number (only if utilizing the paid services such as shopping in our online store, etc.)
    – date of birth
    – other data voluntarily provided by you within the comment section of your order

    Your data are provided voluntarily in different forms on this website: Registration Form, and Contact Form. Your data are used for purposes further specified within this policy, and only to the extent necessary.

    Your data are used in various instances for various purposes. While using our website, we use cookies to obtain data on the preferences of website customers and use this data to customize our offer to individual customers. It is allowed to use cookies to obtain information on whether you previously accessed our website from your computer. Without cookies, we would not be able to obtain information on your preferences and in the online world, we would not be able to satisfy your requirements.

    Based on your preferences obtained through cookies, web logs, and IP addresses, we do not burden you with information that is outside the scope of your interests. If you purchase with us, we use your data to process your order, but also to protect our legal claims and at the same time fulfill our obligations under the law. With the help of your contacts and data, we can display and send you offers tailored specifically to you. We are authorized to process your data by preparing or fulfilling a contract with you, complying with legal obligations or your consent.  

  3. Why do we process personal data?

    – Fulfillment of legal obligations (resulting from a contract) 
    – Fulfillment of tax obligations
    – Information on the status of your order (Shopping Cart)
    – Information about news and updates (in case of new customer registrations or newsletter subscriptions)
    – Answering inquiries (submitted via the contact form)

  4. How long do we store your data?

    We process your data for the entire duration of using our services (i.e., the duration of our contractual relationship), and subsequently based on your consent for a further period of 2 years unless your consent to personal data processing is revoked.

    We would like to point out that the personal data necessary for a proper provision of products ordered or to fulfill all our obligations, whether these obligations result from our mutual contract or the generally binding legal regulations, must be processed regardless of your consent for the period set by the respective legal regulations or according to them including the event that your consent has been revoked.

  5. What are your rights regarding personal data processing? 

    – The right of access to your data - you have the right to request from us a confirmation on whether we are processing personal data that concern your person and if we are processing your data you have the right to access the data and detailed information on all the facts related to the processing of your data (your right of access to your data is regulated by §21 of Act no. 18/2018 Coll. on personal data protection and amendment and supplementation of certain acts and according to Article 15 of the Regulation (EU) 2016/679 of the European Parliament and of the Council. At your request, we are obligated to provide you with the personal data that we process about you, and for the repeated provision of this data, we are entitled to require you to pay a reasonable fee corresponding to the administrative costs.
    – The right to rectification - to rectify your data or amend incomplete personal data (your right to rectification of personal data is regulated by §22 of Act no. 18/2018 Coll. on personal data protection and amendment and supplementation of certain acts and Article 16 of the Regulation (EU) 2016/679 of the European Parliament and of the Council).
    - The right to erasure - Your right to the erasure of personal data is regulated by §23 of Act no. 18/2018 Coll. on personal data protection and amendment and supplementation of certain acts and Article 17 of the Regulation (EU) 2016/679 of the European Parliament and of the Council if:
    (a) the personal data are no longer needed for the purpose for which we obtained or otherwise processed them,
    (b) we obtained the data illegally,
    (c) you revoke your consent to data processing and there is no other legal basis for the processing of personal data,
    (d) you object to personal data processing and no compelling reason to process the personal data prevail or you object to personal data processing according to §27, Section 2 of Act no. 18/2018 Coll. on personal data protection and amendment and supplementation of certain acts,
    (e) the reason for erasure is a fulfillment of the obligation under Act no. 18/2018 Coll. on personal data protection and on amendment and supplementation of certain acts, a special regulation, or an international agreement by which the Slovak Republic is bound, or
    (f) the personal data were obtained in connection with an information society service offering under §15, Section 1 of Act no. 18/2018 Coll. on personal data protection and amendment and supplementation of certain acts.

    You cannot exercise the right to the erasure of personal data if:
    (a) personal data processing is necessary to assert a legal claim,
    (b) to exercise the right to freedom of expression or the right to be informed,
    c) to fulfill an obligation under Act no. 18/2018 Coll. on personal data protection and amendment and supplementation of certain acts, the Regulation (EU) 2016/679 of the European Parliament and of the Council, a special regulation, or an international contract by which the Slovak Republic is bound, or for the fulfillment of a task carried out in the public interest or the exercise of official authority vested in the controller,
    (d) for reasons of public interest in terms of public health according to §16, Section 2, Letters h) to j) of Act no. 18/2018 Coll. on personal data protection and amendment and supplementation of certain acts,
    (e) for archiving, scientific purposes, historical research, or statistical purposes according to §78, Section 8 of the Act no. 18/2018 Coll. on personal data protection and amendment and supplementation of certain acts, if it is probable that your right would make it impossible or significantly more difficult to achieve the objectives of such processing.
    -The right to restriction of personal data processing – your right to restrict processing of your data is regulated by §24 of Act no. 18/2018 Coll. on personal data protection and amendment and supplementation of certain acts and Article 16 of the Regulation (EU) 2016/679 of the European Parliament and of the Council if:
    (a) you object to the accuracy of your data during a time that enables us to verify the accuracy of the personal data,
    (b) the processing of your data is illegal and you object to the erasure of personal data and request instead a restriction of the personal data processing,
    (c) we no longer need the personal data for personal data processing, but you need them to assert a legal claim, or
    (d) you object to the processing of personal data according to §27, Section 1 of the Act no. 18/2018 Coll. on personal data protection and amendment and supplementation of certain acts, and Article 21, Section 1 of the Regulation (EU) 2016/679 of the European Parliament and of the Council.
    If the processing of personal data has been restricted, we are allowed, in addition to storing your data, to process the personal data only with your consent or to assert a legal claim, for the protection of persons or reasons of public interest.
    -The right to data portability – Your right to portability of your data is regulated by §26 of the Act no. 18/2018 Coll. on personal data protection and amendment and supplementation of certain acts, and Article 20 of the Regulation (EU) 2016/679 of the European Parliament and of the Council, in a structured, commonly used and machine-readable format and have the right to transmit those data to another controller where technically feasible and where the processing is carried out by automated means and is based on a legal basis according to §13, Section 1, Letter a) or Letter b) of the Act no. 18/2018 Coll. on personal data protection and amendment and supplementation of certain acts and Article 6, Section 1, Letter a) or Letter b) of the Regulation (EU) 2016/679 of the European Parliament and of the Council respectively, i.e., if we process the personal data based on your consent, due to contract fulfillment or contractual obligation.
    -The right to object – if you no longer wish to receive business notifications or other news information from us, you have the right to object to the further processing of your data for direct marketing. If you do so, we will no longer process your data for this purpose and you will not be receiving further business notifications and newsletters from us.

    You can exercise your rights or submit inquiries regarding personal data processing via a direct request to the controller.

    Exercising the rights in the above manner does not affect your right to submit a complaint to the relevant supervisory authority. You can exercise this right if you believe that we are processing your data in an unauthorized manner or violation of generally binding legal regulations. You can file a complaint against the processing of personal data performed by us at the Office for Personal Data Protection, which is located at Hraničná 12, 820 07 Bratislava 27, E-mail: statny.dozor@pdp.gov.sk.
